Pretrial punishment

Outstanding post today on the outstanding blog Grits for Breakfast about the growing acceptance of pretrial punishment as a legitimate public safety function.

If you’re not convinced, go to Fulton County Jail and watch 2 hours of morning court, any morning of the week, held on the jail’s first floor. Fifteen minutes into the day’s calendar and it comes clear that  these first, second, third appearance hearings of people who don’t make bond is primarily about determining whether someone has done ‘enough’ time pretrial to allow them to plead guilty to time served.  Ditto every other major city’s jail court.
